The corporatocracy that America has evolved into is not the form of government designed for this land by the Founding Persons. Nowhere in any of the founding documents, from the Declaration of Independence over the Articles of Confederation to the Constitution, is there any mention of this land existing in a perpetual state of war that benefits the controlling interests of a handful of massive corporate entities at the expense of civil liberties.

Thomas Jefferson saw an aristocracy of corporations as a threat to humans’ natural rights; and James Madison warned that war is the most dreaded enemy to public liberty. Regardless of these prior warnings, however, America has become exactly what our exalted forbears feared most - a quasi-republic ruled by corporations that together have enough wealth to buy elected officials and siphon real wealth (in the form of gold) out of the economy using perfectly legal methods (the Federal Reserve System, which is a private corporation).

This system will not change anytime soon. The corporations (and the few families who own them) that wield such enormous power are not about to step aside in favor of the freedoms and democratic institutions imagined for us by the Founding Persons. If the existing corporatocracy wanted to let wealth trickle down, wealth would have trickled already; if it wanted to solve unemployment and eradicate poverty, it would have solved and eradicated already. America’s monied ruling class has had centuries of time during which and vast resources with which to create in this great land an utopia of prosperity for all at the expense of none. This author proposes, therefore, that we the People set aside a few small parcels of land (similar to the reservation system) within America in which they who control the undemocratic and unconstitutional corporatocracy may do whatever unimaginably rich persons do besides breathe and eat. On the rest of the land, however, the People ought set up a form of government - one that closely follows the text of our Founding Documents, which include the Declaration of Independence, the Articles of Confederation, and the U.S. Constitution - that to us shall seem most likely to effect our Safety and Happiness.

All power stems from the People, and the existing structures exist only because we allow them to exist. If we are not to bring about the true promise of this grand experiment, then who? And if we are not to do it now, then when?

an unconstitutional presidency

A crisis looms; stormclouds are massing. Unless he can sell off his last holdings and put them all into a blind trust, the president-elect will on 20 January 2017, his inauguration day, violate the Constitution. Should he on that day run foul of the emoluments clause, he will have to be impeached immediately. It won’t make much difference, however, if his violations persist. America long ago abandoned the principles upon which it was founded: there is no clause that calls for the Ynki to act as the world’s policeman, doling out punishment or refraining from applying it as he sees fit; nowhere in the Constitution are provisions for a military industrial complex; nowhere does this nation’s supposedly most sacred text propose that America must be constantly at war for its economy to thrive; nowhere does our founding document indicate that non-human corporations should enjoy the same rights as flesh-and-blood people do, or that the wealth created by society as a whole should be given to a few affluent capitalists. We citizens of America have allowed these aberrations to stand; we citizens of America have allowed these violations to continue. As Americans, each and every one of us is responsible for the crimes and injustices our weapons of war visit upon the downtrodden peoples of this world - be they bombs dropped by us or ones loosed by a tyrannical client-regime.

As discussed in an earlier post, the American government now treats its citizens similarly to how we were treated by the British monarchy before declaring our independence. The rule of law applies to some of us, not all of us equally; armed agents of the state kill us without due process or punishment; taxes are imposed upon us without our consent; our seas lie plundered of their bounty, poisoned by industrial run-off; our coasts and forests sit ravaged, their diversity raped for short-term gain. The incoming president will violate the Constitution as soon as he is sworn in, and few of us will give a shit about it. Welcome to America - land of the greedy, home of the enslaved.

on American imperialism

This author rejects the notion of American exceptionalism. Having read repeatedly the nation’s founding documents, the Constitution and the Declaration, he finds in neither of the two texts cause or justification for imperial ambitions. America was not founded as an empire, and yet it is an empire, today. America exhibits sicknesses and discrepancies similar to those found in previous empires: we spend the lion’s share of our budget on keeping and expanding foreign corporate holdings - most often through aggressive war-making - whilst neglecting our domestic economy and infrastructure, allowing them to crumble; we curtail free speech and civil rights at home whilst paying them lip-service abroad; we imagine ourselves mighty because we had the unthinkable gall to use nuclear weapons in anger yet fail to understand that such brazen and inhuman acts compel other nations to arm themselves similarly; we call for the prosecution of foreign leaders who willingly committed crimes against humanity yet hold our own leaders (e.g. George W. Bush, Dick Cheney, Donald Rumsfeld) exempt from such prosecution even though our own crimes dwarf those of others; we topple legally elected foreign leaders in favor of violent thugs trained by us to subjugate and torture their own people in order to maintain and protect American corporate profits.

Not one of the deplorable conditions mentioned above is called for in the Constitution, this nation’s supposedly highest code of laws, wherefore these conditions are unconstitutional, unjust, and forbidden. There is no justification for America’s imperial ambitions; our acts of war in the interest of short-term corporate profit making violate the Constitutional directives, wherefore they must stop. The America of which we collectively dream - that place where all persons are created equal, where the government acts to protect the Life, Liberty, and Property of all persons instead of merely the financial gains of artificial, immortal entities - that America does not now exist, nor has it ever. We pathetic citizens who demand a return to traditional constitutional values are being ignored, laughed at, and brutally silenced. Woe be unto this nation. Forgive us, world, for we knew what terrible things we were doing, and did them anyway.

pretty much fucked

For the average citizen, ignorance of the law does not excuse him from punishment. Consider that taken together federal, state, and local laws number in the tens of thousands, and change, constantly. Without focused effort, however, most Americans commit 3 felonies a day, as Mr. Harvey Silverglate of Boston writes in his book. When looked at critically, this system seems to exist not to protect or better lives but to extort cash from or transfer into prison-slavery people who get caught breaking said myriad laws. (Please note: according to the U.S. Constitution, slavery is still legal in America, but only as a form of punishment, i.e. prison.) For the citizen working as a police officer, however, ignorance of the law - ignorance even of the fundamental tenets of the Constitution - is met not with reprimand but reward. Following Heien v. North Carolina, citizens working in the police forces can violate the rights and freedoms of their fellow citizens, first performing warrant-less searches then claiming ignorance of the Constitution’s 4th amendment protections against same. What sort of nation allows a heavily armed police force - a standing army beholden to neither established law nor the opinions of mankind - to operate free of the constraints of the very document upon which it was founded? What sort of country sends the armed agents it has chosen to enforce its laws out into the street without first making sure they understand the contents of the very document they at some point swore to protect and uphold? When a terrorist attacks, the various churches of the religion he claims adherence to come forward and denounce his violent ways. Where, however, are the voices of the various police departments around America coming forward to denounce extrajudicial executions committed by their brothers in blue? Are police unions in large numbers urging their members to stop escalating roadside encounters and stating publicly that they do not condone violent acts against unarmed civilians regardless of creed, hue, or race? The police unions are not, and great numbers of police officers are not, because citizens who work as police officers exist not to protect the rest of us but to distrust, fine, follow, track, stalk, and - if startled - shoot those of us who do not work as police officers. Now, more than perhaps ever before, the age-old concerns about watchers (and who watches them) lick hot at the forefront of the mind.

Video recordings abound of police officers shooting unarmed or legally armed average civilians out of at best fearful aggression and at worst hateful convenience. When investigated, most of the shootings are deemed justified - by an attorney general or equivalent legal party who works frequently with the trigger-happy police officer and his colleagues, who must depend on the man’s good favor to efficiently perform his daily duties, and who is thus inclined to find the man’s behavior in accordance with whatever police-specific or special laws that he and his ilk conspire to uphold and protect. (The American people have given police officers leave to break the law - to lie, cheat, and steal - in order to secure a criminal conviction. Ought we be surprised that they’ve decided to include in their list of permitted crimes that of shooting first and asking the questions later?) The lawless savagery of absolute Despotism that occurs when those supposed to keep the peace are given leave to break it - at will and without fear of punishment - runs counter to the letter of our nation’s founding document, the Declaration of Independence. (In reality, It offers the People no protections, however, as in the opinion of the U.S. federal government the Declaration has no legal weight or legislative significance.) Among the causes that compelled the Founding Persons to declare their separation from the British empire was as follows - For Quartering large bodies of troops among us: For protecting them, by a mock Trial, from punishment for any Murders they should commit on the Inhabitants of these States(.) When reading the Declaration immediately after you finish this piece, I challenge you to substitute ‘the King of Great Britain’ with ‘the U.S. federal government.’ How similar to the conditions we face today were those which drove the Founding Persons to call bullshit and ouster their plutocratic overlords? (In a widely-circulated official Pentagon training manual, the Founding Persons - George Washington, Thomas Jefferson, Benjamin Franklin, &c. are referred to as criminal extremists one rung below outright terrorists who would today be barred from military service). Are the conditions we currently face but another example of sic semper tyrannis, proof that a political force of sufficient size and longevity will naturally evolve into the very oppressive and dastardly power it once sought to overthrow - even a political force conceived for and supposedly dedicated to the purpose of bringing betterment and liberty to a large mass of people?

Unless we average citizens do something very soon, the million tentacles of the teenage police-state throbbing in our midst will seek out and suffocate what few freedoms we have left. Since 2001 C.E., civilians working as police officers have killed more unarmed and innocent civilians than the terrorists did on 11 September, albeit one or two and not hundreds or thousands at a time. How does one root out a beast as firmly latched to the fear-teat of modern America as a police force that slays our youth and hounds the defenseless whilst demanding knee-jerk and blind obedience to its every whim and fancy? A beast whose appetite for blood and gore never lingers, whose cruel heart pumps blood black and blue? Not quickly, efficiently, or thoroughly. To start, however, please know your rights, and record every interaction with the police. Beyond that, though, put on some lipstick and rouge, because we the People are pretty much fucked.

on breaking oath

Cop chiefs of America now break their oath to preserve the nation's own Constitution for their standing armies in black fabric clothed destroy Liberty for all – everyone. This foul cheap aggression will not stand for long, for there are vast multitudes, great unarmed throngs, who take to the streets to protest what cops do when they break Amendments I VI VIII and II. Each swine made a pledge to uphold what is Right, to protect the innocent (not cause them fright), to hold themselves to pure and higher standards than worthless effluvia or mere rank turds. Cops kill more Ynki than Arab terrorists; they maim pregnant women teenagers and kids; they think themselves above the established laws; the System protects them, for it's truly flawed. To speak out is deadly to stand up the same, but still we do instead of lying ashamed on beds we all made up when Saudis – those cowards – did fly U.S. airplanes into the Twin Towers. Just after those harrowing terror events did the common citizen quickly relent and give up Protections long granted to him that the Founding Persons did fight for, and win. So take up a banner and march in the streets and record your actions in blogposts and tweets to prove to the generations yet to come that we at least tried to undo damage done.

on discovering Liberty

I am reading the Constitution of Liberty by F.A. Hayek, and my life is changing fundamentally. For years, I have felt strange when arguing certain political points or chasing one or the other topic down its respective rabbit-hole – this book is helping me understand why. Most of my life I have lived under the sway of unsound theories, of counter-productive opinions, of methods that more often than not have lead to failure, sadness, contempt, and woe. Now, however, as the awesome brilliance of the Torch of Progress shines into the dank and fetid recesses of my psyche, the foundations of my soul are beginning to dry out, and solidify. The shrill voice of nagging doubt loses its biting edge as my soul rejoices at the majesty of Liberty's countenance; my energies align as I perform the ancient practices of yoga and meditation; my being soars as mind – free of thought – merges with body to beholds the deep essence of the Universe. It has taken many moons of studying a plethora of unrelated texts to reach this point, and I dare not suggest that following in my footsteps would lead anyone else to the same conclusions. For now, though, perhaps just for today, I see a brightness on the horizon I have not seen in years, and it finally feels as if I am starting to truly understand myself. Huzzah.

no superior state

America's system of elections is broken. Instead of all citizens of voting age sharing equal responsibility and enjoying equal privilege in the selection of their president, certain battleground states have emerged (Ohio and Florida are two examples), states in which political parties and their candidates spend disproportionately large amounts of time and treasure, states that have been granted greater power than their neighbors and fellow members of this oh-so-precious Union. If we elect to the presidency a person willing and able to fix this system, we might all be once again be treated equally; if we elect to the presidency a person with a proven track-record of beating back the ever-creeping tendrils of government, one who will veto unnecessary and wasteful laws and fight the influence of deep-pocketed corporations, we might once again look at ourselves in our mirrors with pride, basking in the knowledge that we are all equal under the law, that not ass nor pachyderm meddles in the Peoples' affairs, that the opinions of not Buckeye nor Cornhusker are valued greater than the political views of Blue Mountaineer or Big Skywatcher. We need a president who will make things better, not worse. We need a president who will sacrifice his chances of re-election so as to battle entrenched corruption and the stranglehold of the war-mongering lobbyist.

For the aforementioned reasons, in hopes of breaking the gridlock of power in Washington D.C., and desiring to throw off the mantle of federal oppression, I endorse governor Gary Johnson for president. For too long have we considered votes for third-party candidates wasted votes; for too long have we tried to choose between the lesser of two evils instead of casting our ballots for that person who we know will reinstate the Constitution's tender grasp, who we know will end our illegal wars of aggression, who we know will restore the Liberty granted us by the Declaration of Independence. Please, dear reader, fight the choke hold of business-as-usual, smash your television-set to bits, and vote for the only man who will revoke both the Patriot Act and NDAA 2012, pieces of legislation passed by both Republican and Democrat that continue to desecrate the Constitution and destroy the freedom and equality for which this nation was once known. No state is more important than the next, no segment of the population more valuable than its neighbor. Only by fighting for Liberty can we secure for ourselves her Blessings; only by joining together as twigs in a bundle can we guarantee for ourselves the peace and happiness upon which our country was founded. Stand up – speak out – vanquish injustice – vote Libertarian!

risky political correctness

A dangerous trend has spread throughout these shakily-united States: the trend of political correctness. Damaging to honesty, truthfulness, and the very concept of Liberty itself, a person is being politically correct when, before speaking out loud, he stops to ponder whether or not what he is about to say might or might not offend someone within earshot. Rather than encouraging him to speak his mind freely in the knowledge that he has no – nada, null, zero, zilch – no control over the mental processes of other people nor the ability to control how others will react to whatever he chooses to say or do or sign or write, our society demands that he take everyone else's emotional and mental well-being into consideration and censor himself instead of just coming and saying whatever the deuce he intended to say in the first place.

Political correctness is un-American in that it forces us to be liars, to hide our prejudices and our stereotypes deep within the recesses of our souls, where hatred and malcontent tend to fester; it decreases the Safety of all Americans by allowing the bigot to mingle freely amongst open-minded people, his cruel heart filled with a resentment for people of color and a hatred for All Things Strange; it harms the Safety of all Americans by allowing bigotry and racism to build up in the mind of the sad and confused individual until he can no longer stand it, which makes him more likely to lash out physically against the object of his ire, a person with skin slightly darker than his. During more than one conversation between me, an American of European Descent, and Americans of African or Mixed African and European Descent (i.e. between a white person and brown people), I have heard these humans say that they would rather have their racist right out in public, where he can be tagged and avoided rather than for him to have to pretend to be color-blind when he really could care less if he saw a Negro being chained to a pickup truck and dragged.

Furthermore, political correctness emboldens the nitpickers and busybodies among us to wag their fingers at anyone even toeing the line of impropriety, and to say to them with self-righteous but artificial indignation: It's not nice to say this, and you shouldn't say that, because you might hurt this bunch's feelings, and cause that lot to be sad. There are many views espoused by religious extremists in this country – they who are trying to shut down Planned Parenthood and who want to amend our preciously secular Constitution to define marriage according to their and only their religious text – views I vehemently oppose and risk Life, Fortune, and sacred Honor to combat; yet while standing out in the snow counter-protesting nuns and stoking the ire of entire church parishes, I chose to speak my mind and to say hurtful and offensive things directly to them, right up in their faces, hardly flinching when they called the cops to complain about the public display of the word vagina, which is the medical term for one part of a woman's sex. I shall stop harping on the past and start encouraging the few lovers of Liberty left on these shores to end self-censorship, to encourage clear and open debate, and to fill their hearts with emptiness; together, we can conquer the scourge of political correctness, preferring honesty to deceit, choosing the Truth over lies. So stand up and speak freely – do it now, or forever scold your niece.

on providing Welfare

For this author, the main reason that we cannot allow Mitt Romney to gain our nation's highest office is that he has never read the Constitution of the United States of America. If the former governor of Massachusetts had at one time read even the preamble to this our second-most sacred document after the Declaration of Independence, he might have retained at least a distant memory that the role of government in this land is to provide for the general Welfare and to secure the Blessings of Liberty to us and to our Posterity. (Perhaps his and his Republican Party's openly-declared plans to amend the Constitution in order to define marriage as between 1 (one) man and 1 (one) woman include secret plans to edit out this embarrassing preamble, this handful of words that contradict Mr. Romney's apparent core beliefs by clearly stating that government in America is supposed to help and uplift as many people as possible, not make as few as possible fabulously rich.)

It is better, perhaps, for Mr. Romeny and the Republican Party in America (or RePIA, pronounced “rape-ya”) to remain ignorant of both the Declaration and the Constitution; if they were to take a closer look at either of these our precious documents, or to do any background investigations into the deeper meanings inherent to these two texts, they may find therein more passages aimed at spreading Liberty and equality amongst the peoples of the world that they would want to remove, amend, excise, cut out, and destroy. Curious to me is that Mitt-the-Governor-of-Massachusetts seemed to understand the role of our government far better than does Mitt-the-Candidate-for-President, he who appears to be catering to – openly and without shame – that billionaire lunatic-fringe that continues to profit from the Great Recession, from this nation's spreading of war across the globe, and from the purposeful and planned destruction of economic equality in America. I watch with consternation while riding my bicycle through this little blue-collar town as more and more banners appear on the lawns of modest homes that support Romney and Ryan; after talking with an Obama-hating neighbor, however, I am gaining some insight into his and the other Romney-supporters' views and methodology.

As far as I can tell, these people passionately hate Obama and timidly support Romney because they expose themselves to the narrow views of but a few political pundits, TV fear-mongers, and syndicated radio talk-show-hosts; they have allowed hatred to fester in their hearts by avoiding any opinions other than those that stoke their ire, preferring cocoons of self-righteous indignation to the rage-stilling effect of a careful and rational analysis of many different sources, news outlets, and opinions (my neighbor mentioned that he despised Obama not for his race but for being an idiot, even though we had not even come close to discussing the tone of our sitting President's skin). Dear reader, please understand that in the past I have been guilty of this same sort of behavior, passionately hating George W. Bush and mocking his every word and deed; now, however, seeing things from the Other Side, I recognize the danger that lurks in such narrow-minded and puffed-up views of the members of political parties. Hatred of this type obscures the true danger that is facing democracy and equality in America, which comes from people thinking that there is a difference between the Democratic and Republican Parties, that one is better than the other, that one has all of the answers and the other, none. Both of these Parties regularly mock the notion of representative government, both cater to fantastically-rich corporate and private donors to the detriment of tens of millions of hard-working average Americans, both are farcical shadows of their former selves, and both long ago sacrificed sacred Honor for the shallow reward of fleeting political power. Woe is unto us, friend – America delenda est; only through dastardly and destructive effort might we change the status-quo, and regain for ourselves all that we have lost. Mahalo, though, and keep fighting.

Commons, constitutional Right

The preamble to the U.S. Constitution states that the role of government is to provide for the general Welfare. We the people, together with local, state, and federal governments, can only accomplish this if we properly protect the Commons, something which neither our system of quasi-free-market capitalism nor today's re-election-focused politicians deem important. The average, hard-working American, however, relies daily on things that make up the Commons, including roads, bridges, radio waves, wi-fi, seams of coal, deposits of natural gas, clean and smog-free air (vital to the health of all persons), clean and potable water (vital to the health of all persons), and national and local parks. Where once, however, a person suffering cold had the right to walk into the woods and collect for herself a few armfuls of wood, now those trees belong to individuals who sell that wood for profit. When something that belongs equally to everyone is sold by one just person, for no other purpose than his or her personal gain, the beauty of the Commons is shattered, Nature's bounty serving not the interests of all persons equally but only the interests of a few, specifically.

Among the gravest dangers facing America today is our loss of appreciation for things that have intrinsic value, that have worth beyond the merely monetary; our system of Me-First capitalism has so infiltrated and poisoned our minds that we think that everything comes with a price-tag, that everything is for sale. If we just admitted to being a nation of whores, a nation focused on the accumulation of personal wealth, if we just fessed up to selling ourselves into wage-slavery in order to maintain our electricity-dependent, non-self-sufficient lifestyles, then our estimation in the opinions of mankind might not be so low; but, as things stand, we come across as childish and hypocritical assholes who complain about the poor state of our lives while sitting around all day watching TV and shoveling food processed by other downtrodden corporate wage-slaves into our ever-expanding stomachs. The notion of the Commons relies on communal sacrifice, on inter-personal sharing, and on the idea that some aspects of our lives – love, mercy, humility, equality, and generosity – cannot be pigeonholed but must remain beyond the realm of definition, classification, and exploitation. To bring about this state of affairs and to rescue our tender humanity from the ever-grasping paws of profit-hungry corporate interests and the greed of unscrupulous men, we must stand together, protecting what belongs to us all with Life, Fortune, and sacred Honor.

The Declaration of Independence defines government as that body which brings about the Safety and Happiness of the people. Furthermore, it grants us the right to alter or to abolish our government should it become destructive of our Safety and Happiness. Friends, Yankis, fellow patriots, we demand that our governments protect the Commons diligently, since clean air, pure soil, clear water, and guaranteed civil rights make us Happy and Safe and poisoned air, barren soil, polluted water, and preferential treatment for avaricious, self-interested individuals makes us Unsafe and Unhappy. The government of the United States of America does not exist to pay $400 billion to defense contractors, to cut taxes for wealthy corporations and rich individuals, to stop funding education, to stop funding programs that assist the poor and the elderly, to attack and kill persons merely suspected of committing grave crimes (such as Al-Awlaki, Osama Bin Laden), to subjugate foreign peoples in order to gain access to their mineral and fuel resources, or to restrict the ability of its own people to consume whichever drugs they decide best; the government of the U.S.A. exists to insure domestic tranquility and to secure the Blessings of Liberty to ourselves and our Posterity, which it does best by protecting the Commons and making sure they stay free to all who may require their bounty. As long as we remain undisciplined and look the other way, however, and as long as we participate in the travesty of conspicuous consumption, we shall remain the enemies of the Commons, blind to the fragile truths which can save us from ourselves. As an inconsequential blogger with a limited readership and few people perusing my various sites (except, perhaps, those sites specific to street art), I am today still writing and kicking and living and breathing, but who knows for how long. The executive office of the United States – that run by President Barack Hussein Obama – violates regularly the rights of individuals, removing them to foreign locations and holding them prisoner without trial (in a process known as rendition), in clear violation of national and international laws (see here for a fantastic article re: the Charter of the Forest). The president and his equally-corrupt counterparts in the U.S. Congress and Senate allow large and well-financed companies – known as corporations because they have the same rights and privileges as actual persons but cannot be sent to jail for the crimes they commit – to rape the lands and seas of their vast resources, keeping the American people stupefied and misinformed via elaborate and ubiquitous advertising that allow these corporations to profit immensely from the sale of the Commons, those being things that belong to everyone equally, those being things such as the ore and metals in the ground, the chemical compounds dissolved in the air and in the soil, the clear and running water that each of us needs to stay alive, and living and growing things such as cotton, trees, soybeans, corn, oats, cows, pigs, peppers, wheat, chickens, etc.

Because I speak of these things, writing often about the overreaches and the abuses of our sitting president, his predecessors, and their well-heeled corporate cronies – they who shift from corporate officer to appointed official, and back again, in a never-ending cycle of sycophantic, avaricious nepotism – because I speak of these things, banging the dinner-gong to the tune of my own unraveling, for this reason, I will be among the first to go. When our leaders in Washington decide it is time to round up dissidents such as me and to put us in prisons and into labor and death camps for re-education and to keep the minds of the general population free of any doubt about the validity and sustainability of our current economic and political systems, then it will be clear that my bleating was not merely the bitter moaning of a spoiled little whorphan, but that my attempts to get the people of this land to think critically about their lives and about how much television they watch and about their lack of self-reliance and about their whole-scale adoption of conspicuous-consumption-oriented capitalism were more than self-righteous chest-beating.

an open letter to America's founding persons

Dear individuals who founded or influenced the founding of the United States of America: may you have a good day. I write to you across a long stretch of time – nearly two hundred and forty years – with greetings and supplications. Much is being said of late in this fine land you crafted so long ago about your intentions, your motives, and your goals. Friends, woe is befallen us, for we have taken the essence of the nation you designed in the Declaration of Independence and trampled it unceremoniously to dust. As Dr. Franklin warned after the ratification of the Constitution in 1787, we have not been able to hold on to the republic you created; rather, we have allowed the forces of blind and inexorable avarice (which we now refer to rather as corporation-based, consumption-driven capitalism) to all but ruin the seemingly boundless promise of your intended nation. No longer does government exist to serve the People – now its punishes with fines and imprisonment those of us who drink deeply of the Blessings of Liberty and who pursue our Happiness as we see best fit without infringing upon the Life, Liberty, or Property of any other person or persons; now it exists not to foster the free mind, the free life, or the free will but to punish the People for not living according to the rules it proclaims will bring the most benefit to the most people, rules, however, which are designed by and written for the benefit of a few hundred thousand of the richest citizens (and their respective corporate bodies) who enjoy privileged access to policy-makers due to their vast wealth, lack of humility, and insufficient focus on the Shared and Common Causes (making all people, equally, Safe and Happy) which should bind us, as countrymen, to one another, indelibly. Justice, friends, has been banished behind such dark and oppressive curtains as hang in our houses of deliberation; her blindfold has been removed in order to combat a poorly defined danger known as terrorism; and her sword now strikes down such persons – both native and foreign-born – as have not even been given a decent or fair trial by a jury of their peers. As mentioned previously, laws exist that promote neither the general Welfare nor that insure the domestic Tranquility but that subjugate the People to the whims of heavily-armed, fear-obsessed, oppression-minded police forces and that divert the vast wealth generated by the collective labor of this nation's citizens into the pockets of those few of us who have the best political connections and the broadest corporate reach. The noble cause of a more perfect Union has been replaced by the nation-wide homogenization of goods and services that has eroded the independent and self-respecting nature of the People, replacing it instead with a sheep-like mentality under which we slave primarily to fuel personal over-consumption of foodstuffs, electricity, and images that are piped at great expense into our homes where they move about on magical picture-boxes hanging from the walls.

Such is our suffering, and more. We move about not under our own power but atop and within auto-mobile metal boxes that are powered by the burning of a liquid pitch, an inflammable black goo that is pumped from the ground in distant places by hirsute, turbaned foreigners who use the profit from the sale of this oil to fund terrorist groups that in turn murder the People and maim our friends. Rather than raising and storing our own crops, we rely on foods that throughout their lives are sprayed regularly with an unknowable mixture of dangerous and volatile chemicals before they are moved nearly to our doorsteps via larger self-propelled metal boxes that travel upon thousands of miles of rock-and-liquid-pitch-paved roads; rather than raise our own livestock, we rely on meats that throughout their lives are injected regularly with an unknowable mixture of powerful medicines and growth-promoting chemicals before they are moved nearly to our doorsteps upon the aforementioned roads. And, due to this lack of autonomous locomotion and this over-abundance of foodstuffs, we have become lazy and fat, suffering therefore from fatness- and laziness-related diseases and dying of them by the hundreds of thousands.

Oh, dear brothers and sisters, you who stamped this nation out of the dust, who risked Life, Fortune, and Honor in order to create a nation dedicated to the Safety and Happiness of a free and independent People, please accept our apologies for destroying all that which you risked to create, and for desecrating and neglecting all that which you worked so hand to bring about. We are weak, we are spineless, and we hardly deserve even the last, dying remnants of that which you so diligently created. Please, dearest fore-fathers and fore-mothers, please forgive us, for we knew the dangers of the path we have stumbled down, choosing it however because it offered us the least resistance. Attention, self-respecting Americans searching, perhaps in vain, for an organization attuned specifically to the concept of Liberty and all that It entails: The time has come for the founding of the Second Sons of Liberty. (See here for information on the original Sons of Liberty.) You are very welcome to comment on this article with suggestions for how best to organize a group of like-minded individuals bent on reestablishing the longstanding but now defunct notion that each free-born American citizen has the duty under not only the Declaration of Independence but also the U.S. Constitution to live her life in such a way as to satisfy her own wants and needs while not at any time, or in any way, infringing upon the Life, Liberty, or Property of any other person or persons.

For too long now have we allowed the aptly-named nanny state to dictate our actions and to try to protect us from ourselves; for too long have we called upon the state and federal governments to enforce prohibitions on the consumption of a great number of stimulating and mood-enhancing substances; for too long have we relied on outside forces to tell us what is good, acceptable, or patriotic, rather than heeding the tender inner voice of Liberty and deciding for ourselves how best to lead our own lives. The original Sons of Liberty, who labored a dozen years before their efforts culminated in a Revolutionary War that brought independence to this fine, broad land, these our brave and selfless predecessors risked their lives, their fortunes, and their sacred Honor to establish a nation conceived in Liberty; this idea of freedom, so harshly infringed upon by the passage of the Controlled Substances Act of 1970, was further eroded by the passage of the Patriot Act of 2001; this notion has all but died from the general American consciousness, replaced by rampant consumerism and its close cousin, unnecessary wastefulness, by automobile-induced sloth, fear-of-the-unknown, over-reliance on “convenience,” and hollow proclamations of this county's supposedly inherent exceptionalism.

It is time for us to retake control of our shared, common future by focusing the national dialogue once again on the power of individual responsibility and the need to respect our shared, common virtues such as frugality, self-sufficiency, minding one's own business, and preserving the environment for the following generations. Please, dear friends, brothers and sisters alike, please secure the Safety and Happiness of the American people by joining us in this effort to found and organize the Second Sons of Liberty (which shall of course be renamed so as not to exclude persons not born male). Our struggle will not be easy, nor will it see a swift or bloodless conclusion, but it is a struggle we must undertake. Let us make sure that our children, and our children's children, are raised in a nation dedicated to little else than making us its citizens Safe and Happy.

As those people sworn to the task of defending the Constitution, police officers may not at any time perform unwarranted searches or seizures.   The Constitution of the United States of America was established in Order to do just a few things: create a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity. Therefore, the federal government of the United States exists for no other reason than to enact these six simple standards; the sole purpose for the continued existence of the U.S. federal government is to ensure that these parameters are met. Beyond the fulfillment of these few parameters, the federal government has no Constitutionally justifiable reason for existence.

  To public figures (such as Bachmann, Perry, Paul) demanding reductions in the scope of government (without considering the Constitutional parameters), the following services are essential to the realization of the parameters of our Constitution, and, as such, are secure in their continuing existence (until feasible replacements are developed):

  Social Security, Medicare, and Medicaid promote the general Welfare;

  The state and federal judicial networks help to establish Justice;

  The state and federal police forces help to insure domestic Tranquility;

  The Constitution, as the common document that shapes the life of every inhabitant in this nation, helps to create a more perfect Union;

  The armed forces provide for the common defence.

  Excluded from this list, however, are the elusive and hard-to-quantify Blessings of Liberty. From liberty, the citizen crafts Happiness, serenity, and peace. Absent liberty, the citizen is reduced to the level of a dumb beast – she becomes a slave incapable of rational action or independent thought. She is restricted in her liberty when denied the right to abort an unwanted fetus. His liberty is destroyed when he is denied his inalienable right to his body, and to consume drugs of his choosing. She is restricted in her liberty when she is forced to abide by the tenets of a religion not of her choosing. His liberty is under siege when he is discriminated against because of the color of his skin, his religious practices, or because of the type of head-covering he wears.

  The freedom-loving inhabitants of this nation are forced to resort to the black market to obtain the substances they desire (such as cocaine, marijuana, and heroin), substances the American citizen has every right to consume (as drug-use affects his body, which is his property to dispose of as he sees fit). The good people of this land must consort regularly with shady and dangerous people who possess of quantities of drugs unobtainable in the legitimate markets. The upstanding citizens of these shores, they who would gladly buy their marijuana (and pay taxes on it) at their local drug store, must fear for their very Freedom every time they wish to pursue their Happiness by lighting up a joint.

  The individual American has, over the course of his life, proven willing and able to fulfill the parameters of the United States Constitution, regardless of the hurdles that government puts in his way. The American citizen is already living a life of liberty (by doing that which he pleases while not infringing upon the life, liberty, or property of anyone else, which is known as “minding his own business”), although he very often has to break existing laws to do so. Domestic terrorist plots foiled in their execution since September 11, 2001 were uncovered for the most part by average citizens who took upon themselves the responsibility of providing for the common defence. (Love and respect to our brave, heroic soldiers who sacrifice regularly, for the common defence, of their time and lives.) The peaceful people of this nation insure domestic Tranquility and establish Justice by going about their daily business with serene and glowing hearts, righting any wrongs they feel are theirs to right while ignoring other wrongs chronically, wrongs such as poverty and homelessness, wrongs that in their continued existence violate the right of each and every American person to be Safe and Happy.

  At its core, my argument is that every act by any type of government in America must fulfill, in some significant way, the parameters of the Constitution. Any legislation that directly violates these parameters, such as the Patriot Act, or the Controlled Substances Act, is unconstitutional. Once legislation is designed according to these parameters, and once all government action is balanced against this short list, our country will surely revert to the horrible messiness of pure and honest liberty.

on illegal hair-cutting

  Timothy Blastac, an unemployed auto-mechanic from this bucolic town near the Mason-Dixon line, was taken into custody today by the federal government for violating interstate commerce laws. Blastac, who since losing his job has been seen cutting his own hair, declined to comment for this story. Agent Brown, the lead FBI investigator on the case, said at the scene, "Mr. Blastac was witnessed cutting his own hair in his back yard using a hand-held mirror and a pair of cheap clippers. Since his actions violate the potential for a discount hairdresser in Pennsylvania, which lies but a few miles away, to perform these grooming services for him, we apprehended him on suspicion of violating interstate markets. Pending further investigation."

  Dalton Lambert, Mr. Blastac's neighbor, said, "I saw Tim out back trimming his mullet, and I joked about it to some of the guys down at the shop... someone must have contacted the authorities." Under the interstate commerce clause found in the Constitution, the federal government routinely punishes individuals for growing marijuana that those individuals could potentially transport across state lines, thus potentially affecting potential markets in other states, even if those markets are neither legitimized nor regulated under legislation of any type.

  Mr. Blastac, by allegedly performing grooming services on himself that could have been performed by an individual in a neighboring state, allegedly compromised the potential for an individual in a market in another state to potentially profit from potentially performing these services. "We will not tolerate violations to potential markets," chief inspector Ryan Henneman, of the ATF, said. "Just as growing vegetables in your own garden violates the potential profits to be made by for-profit vegetable growers in other states, we cannot allow individuals to perform services on themselves that could potentially be performed by individuals in other potential markets, in other states."

  The federal government has issued blanket warnings to individuals who mow their own lawns, raise livestock such as chickens or rabbits for their own consumption, or maintain and service their own vehicles, as well as any activities that smack of self-sufficiency or self-reliance, saying that individuals performing these tasks, which all violate potential markets in potentially different states, will be brought to justice.

  "We have for too long allowed these violations of potential commerce among the states to go on unpunished," Agent Brown said. "Soon the general public will understand that the potential rights of potential markets to make potential profits far exceeds the fourteenth (XIV) or the fifth (V) Amendment right of the individual to his or her liberty, or to decide for his or herself when and how to cut his or her own hair or what it is he or she should grow, smoke, or consume, on his or her private property." The ACLU declined to comment for this story.

on the necessity of union

  When the Declaration of Independence was written, and its sister document, the Constitution, the need for Union among the States was great. Joined in Union, the States proved better able to effect their independence, and to stand strong collectively, a dozen-odd entities working together against the many pressures that faced our young nation as it fought to make a place for itself in the world, and to prove that its shockingly progressive ideals had staying-power.

  Then, halfway through the 19^th century, divergent forces and interests among the States compelled them to split apart into two separate nations, one seeking to maintain a slave-based economy, the other seeking, officially, to maintain the Union. Whole populations that no longer felt that they should be following the same path rose up in conflict, two seemingly foreign peoples that understood that they had grown simply too far apart in thought and in method to be able to stay together. In those times of relative national weakness and persistent internal turmoil, the Union held; it has held through two world wars, scores of other police-actions (including Vietnam, Afghanistan 2001, Iraq 2003), and rapid and widespread cultural and societal transformations both here and abroad.

  Today, however, we have witnessed the ascendancy of a federal supremacy over the states, and within that supremacy the elevation of the executive branch (in clear violation of the checks and balances built into the Constitution), as well as growing divergences between the citizens who live in roughly the same areas as those that split asunder in the 1860s. Two loose but still recognizable camps have formed in this nation, with millions of voters hovering at varying degrees around the edges of each, one camp calling for more punitive and dogmatic responses to our problems, a camp that relies on the gullibility of the masses for the propagation of its conservative views on religion and society, the other camp one that strives at least superficially for rational debate, the reinstatement of the constitutional right to liberty, and a more compassionate and socialistic view of the role that government and society must play in the elevation of the American People and in the bringing about of our Safety and Happiness. (It would be convenient to suppose that I am here referring to Republicans and Democrats respectively, but as these parties have become the necessary repositories of most anyone seeking political office, their ranks are as varied in their opinions as is the greater population, which is split roughly between liberals and conservatives, i.e. between those who seek to propagate liberty through rational debate and those who seek to maintain the status quo through Fear Of The Unknown and an inflexible mind-set. In my opinion, open debate and rational thinking are essential to the propagation of liberty, for the concept of liberty presupposes that the individual is capable of deciding for himself how best to lead his life: it demands of him that he understands the consequences of his actions while allowing him to live a virtuous life devoid of willful violations of the life, liberty, or property of his fellow persons.)

  Perhaps it would be best, then, in this time of America's military supremacy around the world (when no danger is clear and present enough to enact our total destruction), in this era of seemingly irreconcilable rhetoric and clear societal, moral, and religious divergence, to conclude with this chapter of our experiment and, as the Union of all States is no longer absolutely necessary for the basic preservation of our nation, to allow those portions that wish to pursue their own course to secede.

  Since our country's inception, we have added a good number of states, in locations sometimes far-flung from our original borders, states that by their isolation are seen even now as distant lands and foreign peoples whose primary binding characteristic is the feeble, cancer-like presence of the homogenized corporate retail location. In the interest of DomesticTranquility, it would be better to allow those who wished to establish a socially conservative nation based on a particular religion where they might better keep the ignorant in Fear, a place where the individual might not have the right to decide for herself how to affect her body (by tattoo, weight-loss, or abortion), where the benefits of the joining of individuals in marriage or civil union would be bestowed only according to the writings of a specific religious text (and not to homosexuals or to couples of different hues), where a specific language might be declared (the USA haveno official language), and where a specific system of beliefs might be recognized by all, unanimously, as the state religion.

  Perhaps the citizens of America should be asked directly if they feel that these two clearly divergent populations should become separate nations, an official poll to gauge the possibility of such a split, even an outright vote for their fragmentation and reintegration as separate nations according to the wishes of the respective majorities. (These new nations would have to be well-established, sovereign states with clearly demarcated borders, their constitutions well-written, with provisions in place for the unobstructed movement of goods and people between them, especially people who decide, within a set amount of time, that they had made a mistake and would like to switch nations.)

  The essence of liberty that flowered in America and in the world during the 1960s was stamped out in this country for a number of reasons, among them conservatism, Fear of the Unknown, war-mongering, and racism. Chief among these reasons, however, was the passage of legislation prohibiting the use, possession, and distribution of mood altering substances such as marijuana, legislation that to this day continues to violate the liberty of the American People by restricting their ability to obtain and use legally those substances that they deem would best assist them in their pursuit of Happiness.

  Until such time as the citizens of America are granted their constitutional rights to life, liberty, and property; until such time as their right to abort unwanted fetuses and to use whichever substance they decide are best and to marry whomever they please; until such time as the citizens are entrusted fully with their unalienable right to choose for themselves how best to lead their lives and they regain the right to pursue their Happiness as they decide is best; until that time, liberty does not abide in these United States, and the rights enumerated in the Constitution are null and void. (If any one portion of the Constitution becomes null and void, the entire Constitution must be considered null and void.)

  Certain constitutional protections (against unwarranted searches and seizures) continue to be violated courtesy of the Patriot Act. Similarly, enforcement of the Controlled Substances Act violates the individual's fifth and fourteenth Amendment right to property, because her body is her only true property, and she can do with her property whatever she wants, so long as she is not harming anyone else's property. Since some of the most fundamental rights and protections our Constitution was supposed to have provided continue to be withheld from the American people, we must assume that our Constitution is no longer functioning as intended, that is has been so abused and mocked that it more resembles a nice thing to read on a sunny afternoon than a bedrock legal document. With this our finest document already torn, tattered, and violated, with our most basic rights and protections reduced to the theoretical, we would do well to allow those seeking liberty to break off from those seeking to cling fearfully to the mistakes of the past, that a new Union based solidly on the principles set forth by our nation's forefathers might be formed, a new nation that would not rest until the Blessings of Liberty were guaranteed to ourselves and our Posterity, equally and without undue restriction.

  Let the religious zealots thump their holy books and legislate according to their morality, in their own nation, while they funnel the wealth of their people into the pockets of the richest one percent. We rational, progressive, compassionate few, we who yearn for liberty, we who would like to affect our bodies and to pursue our Happiness as we see fit, our Safety protected by the might of the Declaration, our rights as enumerated in the Constitution immutable and unalienable now, and forever.

  Only through constant vigilance and rational foresight can we ensure Liberty and Justice for all. Stand up. Speak out. Demand your constitutional rights. While this struggle may seem nearly over, we have not yet begun to fight.

on safety vs. liberty

  In America today, we face a simple choice: whether to fight for our freedom or to continue on our present course, and sacrifice freedom to the hollow lie of false security. (By false security I mean the efforts by our government to control the lives the American People by restricting what they do to their bodies, and by punishing them for pursuing Happiness or for exercising Liberty, efforts that mock and destroy the tender concept of freedom by trying to make it one-size-fits-all, when it is a messy, individualistic affair too easily ruined through external tampering.)

  We, the People of America, are not a free people. We have allowed our freedom to be taken from us. We have allowed, for forty (40) years, the Controlled Substances Act to destroy our freedom to choose what to do with our own bodies (thankfully, it is not yet illegal to get tattooed, or to undergo elective surgery, two activities that alter the body just as much as recreational drug use). We have allowed the Patriot Act to do violence to the Constitution, and to rob us of our once inalienable protections. We have allowed our police to focus on sidestepping our Constitutional protections (by letting them brow-beat citizens into body and property searches, and by letting the police lie, cheat, and steal in order to bust criminals engaged in non-violent “crimes”), a focus that negates police effectiveness and that forces them daily to violate their most sacred of oaths, as they have all sworn to defend and uphold the Constitution of the United States of America. (A police officer actively involved in persuading a citizen to give up his Constitutional protections is actively involved in destroying the U.S. Constitution.)

  We have allowed all these things to happen because we have allowed Fear into our hearts. When, in the early Seventies, we saw our crime rates rise, we blamed it solely on drug-use, and banned the use of certain substances (thereby robbing the American people of the right to dispose of their bodies any way they wanted), while not banning certain other substances – alcohol and cigarettes – substances that have maimed and murdered millions of America's sons and daughters. When faced with the consequences of our failed foreign policies (09SEP2011), we gave up our freedom, preferring to have our liberty violated by persons within our own government rather than to have it violated from without. For these reasons, we are no longer a free People. For these reasons, ours is no longer the land of the free (for Liberty knows few personal restrictions), nor is it the home of the brave (for the pure of heart rejoice always in their impending death: they fear only cowardice).

  In concurrence with the erosion of America's common dream, we have seen the erosion of our most basic and fundamental concepts. Our patriotism has been supplanted by conspicuous flag-waving and banner-hanging (very often in blatant violation of the code governing the treatment of the flag of the United States of America). Our secular morality has been high-jacked by the forces of religious conservatism (to become xenophobic proxy-racism). Gone are the days when we were told to fear nothing but fear itself: now we are told exactly what to fear, and that we have a whole lot more to fear that we ever thought we were capable of being afraid of. Our once-great traditions of story-telling and gung-ho, can-do enthusiasm have been tongue-lashed out of us by our corporate overlords; they have shriveled to almost nothing before the inexorable, terrible beauty of television.

  Brothers. Sisters. Fellow New Guards for our future Security. Now is the time for your voices to be heard. Now is the time to recover for our Posterity the promise of this land, and to free our constitutionally-guaranteed Liberty from the shackles of repression, religion, and fear.

  Freedom, much like democracy, is always messy: its expression will hurt someone else's feelings, every time. But as much sacrifice as freedom demands, it repays tenfold with deep, abiding confidence, with true and tender self-respect. So take a chance, and take your opinions known: it does not matter what you have to say, merely that you are saying it out loud, in full accordance with your Constitutional rights.

  It is easier, far easier, not to fight for the Blessings of Liberty that the Constitution guarantees: all we have to do is continue to do nothing, to let the enemies of freedom take from us the few liberties we have left.

  This cannot come to pass. Stand up. Speak out. Challenge everything.

on slavery as punishment

  The thirteenth amendment to the US Constitution reads, "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."

  By any measure, this amendment does not abolish slavery - it makes slavery into an acceptable, official form of punishment. If my memory serves me correctly, however, few if any convicted criminals have been sentenced recently to slavery or indentured servitude. The use of slavery as a punitive measure would be more useful in some situations, less in others. A petty thief is fairly likely to renounce his life of crime after a few hard seasons under the lash, while a corporate officer convicted of fraud and embezzlement, a white man accustomed to the finest treatment his ill-won gains could bring him, such a man might just emerge from his grueling months toiling in the hot summer sun a humble and reformed person. Similarly, a man-slaughtering cuckold is unlikely to find redemption in tall swaying fields of sugarcane (a modern industry in which slavery is still widespread today), while the bankers who were allowed to profit enormously from the sale of fraudulent mortgage-backed securities would truly understand the meaning of labor if put to task making self-guided V2 rockets in the caves of central Germany.

  Perhaps is is because so many Americans have enslaved themselves willingly to the whore-gods of small-scale capital gain and conspicuous materialism that slavery is not used more frequently as a punitive measure: the slave is already under the yoke, so allowing her to max out her credit cards and providing her with no better outlet at which to express her abounding creativity and endless potential – in her pursuit of food, shelter, and clothing, the Three Fundamental Components of Safety – no better outlet than some menial, repetitive job, her self-imposed and self-maintained slavery ensures that the fruits of her hard labor are not afforded to her but to the very few persons who sit atop America's pyramid-scheme of capitalism. The slave will be in debt until the day she dies, always struggling to make the minimal payment for things she did not truly need, and could not truly afford.

  I abhor slavery. I do not think any person should ever be put (or put themselves) in chains, but as long as our Constitution states that slavery can be utilized as a way to punish criminals, we should consider using it to bring the false princes of capitalism down a peg or two. The humble are not just the backbone of civil society, they are its savior.

counter-protesting - day # 4

  This picture shows the sign I have been holding on the square in Hanover PA for the last few days (the opposite side reads, CHOICE = LIBERTY - DEFEND THE CONSTITUTION). Today, however, things got a bit nasty: a priest showed up, grabbed the pro-lifers' only PRAY TO END ABORTION sign, crossed the street, and stood directly behind me for a good forty-five minutes. We had a brief conversation about the freedom of speech (he was incredulous when I told him that most modern nations allow their people to speak freely), but he retreated all the same, with a farewell, "See you later," when his attempts at intimidation didn't cause me to immediately vacate my spot.

  Many were the people who voiced their support for my efforts at counter-protesting, among them a shopkeeper from a nearby store (who praised me for keeping my distance from the pro-lifers and not posting up directly behind or next to them), truck drivers, people in passing cars, and the very nice couple who, out of solidarity, bought me a coffee and a water. Many also were the people who voiced their opposition to my signs, either through thumbs down or by yelling angry threats from passing cars.

  The culmination of my day, however, was when the local police showed up to inform me that they had received multiple complaints about the fact that I was displaying in public the word vagina. "This is borderline disorderly conduct," the officer said; "you have the right to speak freely, but we're getting complaints about the word vagina on your sign." I asked him if I could complain about the fact that the pro-lifers have pictures of dead and bloody fetuses on their signs, which I find disturbing and offensive, and he told me to file a complaint at the station. He took my name, address, and date of birth, and thanked me for being civil about the complaints. When I raised my coffee to him as I was packing up and he was pulling out of the parking area where I had been standing, he nearly shouted out with glee.

  I can imagine only one source for the complaints: the pro-lifers who had tried to bring out the big guns, and, having failed to shake my resolve, turned snitch. To stay out of trouble with the law, I will change my sign to read, "KEEP YOUR PRAYERS OUT OF MY WOMB," but womb is not nearly as memorable as vagina. Every action has an equal and appropriate reaction. I refuse to turn snitch and complain about signs bearing bloody and mangled fetuses, but I will not abandon my battle to secure for the women of this land the Blessings of Liberty.
